in termini monetari del biglietto, pari ad un importo di € ...., acquistato tramite TicketOne in data../../ 2019, ID ORDINE N..., FATTURA N......, intestato a ...... relativo al concerto di Paul McCartney che avrebbe dovuto aver luogo a Lucca, in occasione del Lucca Summer Festival, in data 13/06/2020.
A causa della situazione di emergenza sanitaria internazionale, che si è venuta a creare a causa della pandemia per Covid 19, è stato da voi comunicato ufficialmente l’annullamento, e NON il rinvio, del concerto de quo rinviando alle vigenti normative di legge per ciò che concerne le modalità di rimborso.
A tal proposito il DL del 17/03/2020 ed il successivo DL Rilancio pubblicato in data 15/03/2020, recanti disposizioni e misure per il settore cultura, prevedono il rimborso attraverso l’erogazione di voucher di pari importo al titolo di acquisto da utilizzare entro 18 mesi dall’emissione.
Ebbene tale modalità di rimborso non può essere accettata comportando di fatto una penalizzazione per il consumatore che si vedrebbe costretto ad accettare un’unica forna di ristoro.
L’annullamento dell’evento ha di fatto provocato la risoluzione del contratto, concluso in data ..../.../2019 nelle modalità descritte al capo 3) ai sensi dell’art. 1458 c.c. facendo maturare il diritto del sottoscritto alla restituzione di quanto versato in esecuzione del contratto.
Le modalità di rimborso mediante voucher previsto dall’art. 88 del Decreto Legge 18 del 17 marzo 2020 ( convertito in legge il 24 aprile 2020) viola gravemente le condizioni generali di contratto vigenti al momento della stipula dello stesso ed è contrastante con i diritti basilari del consumatore riconosciuti anche in sede comunitaria.
Inoltre le modalità indicate da TicketOne risultano essere addirittura vessatorie, essendo state predisposte unilateralmente senza alcuna approvazione da parte della sottoscritta.
Si sottolinea che in un caso analogo (quello del rimborso dei viaggi annullati a causa della pandemia), la Commissione Europea ha fortemente raccomandato agli stati membri di offrire libertà di scelta fra rimborso in termini monetari e voucher, ammettendo implicitamente l’illegittimità della pratica del voucher obbligatorio con cui si vorrebbero penalizzare in maniera inaccettabile gli utenti degli eventi musicali dal vivo.
Tutto ciò premesso, con la presente la sottoscritta ...
Vi invita e diffida
a corrispondere il rimborso monetario della somma versata, pari a € ...., tramite l’emissione di un assegno circolare intestato all’istante o accredito al seguente IBAN . ...
con espressa riserva, in caso di mancato positivo riscontro alla presente, di adire la competente Autorità Giudiziaria per la tutela dei propri diritti.
La presente vale anche ai fini dell’interruzione dei termini per la richiesta di rimborso mediante l’emissione di voucher.
Da valere quale diffida e messa in mora a tutti gli effetti di legge.

the voucher fulfills organizer's refund obligations and it imposing itself on the
buyer, not requiring his acceptance.

a seguito dell'anticipata cancellazione dell’evento Paul McCartney a Lucca Vi ho chiesto con mia del 03/06/2020 il rimborso del prezzo dei n. ….biglietti che a suo tempo mi avete venduto, pari a complessivi Euro …..
Con Vostra del 04/06/2020 mi avete comunicato che, invece di rimborsare l’importo dovutomi, mi proponete un voucher dell’importo facciale di Euro… da utilizzare entro 18 mesi per assistere ad altri eventi musicali, peraltro allo stato attuale neanche identificati con certezza.
Quantunque facciate richiamo alle previsioni dell’art. 183 comma 11 D.L. 19.05.2020 n. 34, tuttora in attesa di conversione, con la presente comunico ai sensi e per gli effetti dell’art. 1197 c.c. che non consento che Vi liberiate dall’obbligazione promettendo prestazioni diverse da quelle dovute.
Insisto quindi per il rimborso integrale dell’importo dovutomi ed ingiustamente trattenuto nonostante la mancata organizzazione dell’evento e, in difetto di Vostro adempimento, avverto che - trascorsi 15 giorni dalla data della presente lettera di messa in mora - agirò a tutela dei miei diritti nelle forme di legge, presso ogni competente sede, senza ulteriore preavviso e con aggravio di spese ed interessi.

I therefore insist on the full refund of the amount due and unjustly withheld despite the failure to organize the event and, in the absence of your fulfillment, I warn that - after 15 days from the date of this letter of formal notice - I will act to protect my rights in the forms of law, at each competent office, without further notice and with an increase in expenses and interest.

Are people going to request the vouchers? Im not sure what to do. If we request the voucher does that mean we agree to them... and if we dont does that mean we will just get nothing?
At the moemnt I think I will just hold out and not request the vouchers and hope McCartneys people release a statement saying they will refund fans

Hi! Can anyone, please, share, how exactly shall we send them the photos of our tickets to get this voucher? I'm thinking about getting it and then selling it a bit cheaper to someone who might actually use it. I guess this is the only way to get some money back.
I've tried to contact ticketone help via email, but they never came back to me.
Was going to Naples from St Petersburg, Russia to see PM for the first time ever - haha!

The contract is between the ticket purchaser and the person/company selling the ticket. It has nothing to do with Paul or his company so there's no need for him / them to get involved. Its a bit like buying a cinema ticket to see the new Beatles film only for the cinema to cancel the showing and offer a voucher for a future film instead. It's hardly the Beatles fault.

NO TO VOUCHERS!
We defend the indispensable right of families to reimburse the large sums spent to attend two irreplaceable historical events, which have been DEFINITIVELY CANCELED and not simply postponed.
In this macroscopic case, the provision of replacement vouchers as the only obligatory form of reimbursement allows the two partners of D&G, Mimmo D'Alessandro and Adolfo Galli, to forfeit the multi-million dollar collection of TWO EVENTS THAT HAVE NEVER ORGANIZED, limiting themselves, in good in essence, to some announcements in the press conference and to the printing of posters, and which - by their own declaration - they intend to use TO FINANCE OTHER FUTURE EVENTS OF THEIR AGENCY.
Which, actually consisting in the mere and simple point of reference of the REAL ORGANIZATIONAL MACHINE of some renowned artists, has a small number of employees.
And with little consideration of the sacrifices that Italian families are facing today, these "promoters" - such because they are so recognized and benefited by law - declared to the press that they "DON'T REMEMBER EXACTLY WHAT COSTS HAVE BEEN INCURRED" for the ONLY ANNOUNCED EVENTS by Paul Mc Cartney, adding "TO HAVE MAYBE PAID 500,000 EURO IN TAXES ”And to have now intention to" finance FUTURE EVENTS "of their D&G agency.
